1. Agreement to Terms

By accessing and using AI Influencers Store (the "Website"), purchasing any products, or using any services, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you may not access or use our services.

These Terms apply to all visitors, users, and customers of AI Influencers Store.

2. Trademark & Intellectual Property

The AI Influencers Store — including all branding, avatar designs, images, promotional materials, storylines, product packaging, and community content — is the exclusive intellectual property of its creators. All rights reserved.

• No Copying or Reproduction
  You may not copy, duplicate, resell, or redistribute any avatars, concepts, branding, product layouts, or business models found in the AI Influencers Store without explicit written permission.
• Personal License Only
  Your purchased AI Influencer is licensed for your personal or commercial use only (unless you purchase Master Resale Rights). The influencer may not be shared, transferred, or resold without proper licensing.
• No Inspiration Theft
  Direct imitation of the AI Influencers Store branding, design style, avatar format, naming conventions, packaging, or business structure — for resale or competitive purposes — is strictly prohibited.
• Legal Protection
  AI Influencers Store content is protected under intellectual property law. Unauthorized use, reproduction, or distribution may result in legal action.

3. Exclusive Ownership Model

Once you purchase an AI Influencer, she is permanently removed from our store. No one else can ever purchase or use that same influencer. You have 100% exclusive rights to her images and persona.

What This Means:

• No duplicates will ever be sold
• No restocks of sold influencers
• Your influencer is unique to you forever
• Complete exclusivity guaranteed

4. Usage Rights & Licensing

📸 Pre-Purchase Media Usage

We create promotional media (photos, videos, graphics) to showcase each AI Influencer inside the store and on our brand platforms before purchase.

🔄 Ownership Transfer Upon Purchase

Once you purchase an AI Influencer, all commercial and creative rights to her likeness transfer directly to you. You control her branding, direction, and future use.

📌 Pre-Existing Marketing Media

We retain the right to continue displaying media created before your purchase across our website, social channels, and marketing content. We will not create new media using your AI Influencer after she becomes yours.

If you'd like, we can tag your influencer's new profile when using previously created promotional content.

✅ What You Can Do With Your AI Influencer:

• Use on social media (Instagram, TikTok, Facebook, etc.)
• Create content for your brand or business
• Promote affiliate products or services
• Build a faceless online brand
• Edit, modify, or enhance the images
• Use in advertising and marketing campaigns
• Create derivative content (videos, graphics, etc.)

❌ What You Cannot Do (Without MRR License):

• Resell the AI Influencer images to others
• Share or distribute the images publicly for free
• Transfer ownership to another person
• Claim you created the AI Influencer yourself

Note: Master Resale Rights (MRR) packages have different terms. See your MRR License Agreement for details.

5. Acceptable Use Policy

You agree NOT to use the AI Influencer images for:

• Illegal, harmful, or fraudulent purposes
• Hate speech, discrimination, or harassment
• Impersonation or identity theft
• Spam, phishing, or deceptive practices
• Violating any third-party rights
• Creating deepfakes or misleading content claiming to be real people
• Any activity that violates local, state, or federal laws

6. Purchase Terms & Payment

💳 Payment Processing

All payments are processed securely through Stripe. By making a purchase, you agree to Stripe's terms of service and privacy policy.

💰 Pricing

All prices are listed in USD and are subject to change without notice. The price you pay is the price displayed at the time of purchase.

🚫 No Refunds

All sales are final. AI Influencers are digital assets with immediate ownership transfer, meaning no refunds, exchanges, or cancellations are possible once payment is processed.

Because each AI Influencer is exclusive and permanently removed from our store upon purchase, we cannot offer refunds under any circumstances.

📧 Delivery

• Mini Package ($47): Delivered to your email within hours
• Solo Package ($97): Custom delivery within 24-72 hours via email
• MRR Package ($127): Custom delivery within 24-72 hours via email, includes MRR license documentation

It is your responsibility to provide a valid email address. We are not responsible for delivery failures due to incorrect email addresses or spam filters.

7. Disclaimer of Warranties

AI Influencer images are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy or completeness
• Error-free operation

We do not guarantee that:

• The images will meet your specific requirements or expectations
• The images will generate income or business results
• The images will be error-free or uninterrupted
• Any defects will be corrected
• The use of AI Influencers will achieve specific outcomes for your business

You assume all risk associated with the use of these digital assets.

8. Limitation of Liability

To the maximum extent permitted by law, AI Influencers Store and its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• (a) Your use or inability to use our products or services
• (b) Any unauthorized access to or use of our servers or databases
• (c) Any bugs, viruses, or other harmful code transmitted through our services
• (d) Any errors or omissions in any content or materials
• (e) Any third-party content, conduct, or services
• (f) Your use of the AI Influencer images in your business or marketing

Our total liability to you for any claims arising from your use of our services shall not exceed the amount you paid for the product.

9. Indemnification

You agree to indemnify, defend, and hold harmless AI Influencers Store, its owners, employees, contractors, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or expenses arising from:

• Your use of the AI Influencer images
• Your violation of these Terms and Conditions
• Your violation of any third-party rights
• Your violation of any applicable laws or regulations
• Any content you create using the AI Influencer images

10. Governing Law & Jurisdiction

These Terms and Conditions are governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of our services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, or in the courts having jurisdiction, at our sole discretion.

By using this website and purchasing our products, you consent to the jurisdiction and venue of such courts and arbitration proceedings.

11. Changes to These Terms

We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting to this page.

Your continued use of our services after changes are posted constitutes acceptance of the modified Terms.

We will update the "Last Updated" date at the top of this page when changes are made.

It is your responsibility to review these Terms periodically for updates.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of law, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect and enforceable.

These Terms and Conditions, together with our Privacy Policy and any MRR License Agreements, constitute the entire agreement between you and AI Influencers Store regarding your use of our services and supersede all prior agreements, understandings, and communications, whether written or oral.
